AS EXPLAINED BELOW, THE RULES REQUIRE THAT DISPUTES ARISING OUT OF OR RELATING TO THIS CONTEST BE RESOLVED IN ARBITRATION IN NEW YORK, NY, USA ON AN INDIVIDUAL BASIS, RATHER THAN BY CLASS ACTIONS OR JURY TRIALS, AND LIMIT YOUR RIGHTS AND REMEDIES IN THE EVENT OF A DISPUTE. THIS CONTEST IS GOVERNED BY U.S. LAW.
GRAND PRIZE WINNER MUST BE ABLE TO TRAVEL APRIL 6th-9th, 2018.
CONTEST PERIOD: The WWE Champions Real World Prize Contest (the “Contest”) begins on March 29, 2018 at 4:00 pm PT and ends on April 5, 2018 at 4:00 pm PT (“Contest Period”). The Sponsor of this Contest is Scopely Inc. (“Sponsor”). The Administrator of this Contest is The Concept Studio, LLC (“Administrator”).
ELIGIBILITY: The Contest is open only to legal residents of the 50 United States of America, District of Columbia, United Kingdom and Canada, except Quebec, who are at least 18 years of age or older (or 19 in Alabama and Nebraska and 21 in Mississippi). Void in Quebec and any country or territory not specifically named above and where prohibited by law. Each entrant must be the rightful owner (or have authorized use) of the WWE Champions game account used to enter. In the event of a dispute as to the identity of an entrant, the entrant will be deemed the natural person in whose name the account was opened. Employees, shareholders, officers, directors, agents, and representatives of Sponsor, Administrator, [World Wrestling Entertainment and each of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives and participating promotion and advertising agencies and any entity which is involved in any aspect of the creation, production, operation, execution or fulfillment of the Contest and their respective immediate family and household members are not eligible to participate in the Contest. Immediate family means parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. Household members mean those people who share the same residence at least three months a year. Subject to all applicable laws.
PRIZES: One (1) Grand Prize (First Place Event Finisher): A trip for two to WrestleMania® 34 in New Orleans. Prize consists of: Two (2) tickets (for winner and guest) to WrestleMania® 34 at the Mercedes-Benz Superdome in New Orleans, LA on Sunday April 8, 2018; round trip coach air transportation for winner and guest between major airport nearest winner’s residence and New Orleans, LA; hotel accommodations (double occupancy) for the nights of April 6-8, 2018; and ground transfers between airport/hotel and hotel/venue. WINNER AND GUEST MUST BE AVAILABLE TO TRAVEL APRIL 6 – APRIL 9, 2018. All arrangements are subject to availability and Sponsor’s discretion. If winner lives within 250 miles of New Orleans, LA ground transportation may be substituted in lieu of air travel. A major credit card will be required at hotel check-in to cover any miscellaneous expenses. All taxes and any other expenses not stated herein, including without limitation, meals, gratuities, travel insurance, optional extra activities and other incidentals are the sole responsibility of the winner. Winner and guest must travel on the same itinerary and have all necessary documentation, including passports and visas, for travel. Winner and guest cannot be on any governmental or airline list making them ineligible for travel. Travel companion must be at least 18 years old or applicable age of majority. Approx. retail value of Grand Prize is US $3,000.
One (1) First Prize (Second Place Event Finisher) : A signed WWE® Title Belt. Belt is a replica of the real title belts used in the WWE. Belt will be signed by a WWE® Superstar to be determined solely in the discretion of the Sponsor. Approximate retail value of First Prize is US $500.
One (1) Second Prize (Third Place Event Finisher): 1 Wrestlemania 34 event folding chair. Approximate retail value of Second Prize is US $250.
No substitution or transfers of a prize, including redemption for cash, except at Sponsor’s sole discretion. If any portion of the Grand Prize does not take place as currently scheduled, for any reason including postponements or cancellations, Sponsor at its sole discretion may change the prize dates or cancel that portion of the prize relating to the event, in which case that portion of the prize will be forfeited in its entirety and no substitution will be provided except at Sponsor’s sole discretion. Grand Prize Winner, for him/herself and his/her guest, agrees to comport themselves in appropriate conduct and to not engage in any illegal or other activity which would harm the Sponsor’s of the WWE’s reputation. Failure to do so may result in disqualification or forfeiture of prize (or any remaining portion thereof) at Sponsor’s discretion.
All federal, state and local taxes and any other costs and expenses associated with acceptance and/or use of the Prizes not specifically provided for in these Official Rules are solely the Winner’s responsibility.
Grand Prize Winner must supply Sponsor with a complete and valid IRS Form W-9 prior to receiving Prize. The value of each Prize is taxable to Winner as income.
WINNER SELECTION: Prize Winners will be determined by the Sponsor based upon the highest point total accumulated by an entrant for the contest period. The entrant with the highest point total will be the Grand Prize Winner; the entrant with the second highest point total will be the First Prize Winner and the entrant with the third highest point total will be the Second Prize Winner. In the event of a tie, the winner will be determined based upon a WWE trivia contest administered by the Contest Administrator.
VALIDATION: Potential Winners must be validated prior to being declared a winner. Potential winners will be notified by Administrator promptly after selection. Winners must sign and return an affidavit of eligibility, prize/publicity release within twenty-four (24) hours of the notification from the Administrator. Potential Grand Prize Winners must also timely have signed and return an IRS W-9 and guest travel release. Failure to do so may result in disqualification without notification and selection of an alternate winner, time permitting. Residents of Tennessee are not obligated to sign a publicity release. If a potential winner cannot be reached, fails to timely respond, is found to be ineligible at any point during the administration of the Contest, cannot or does not comply with these Official Rules or the Sponsor’s or Administrator’s instructions, or if the prize, prize notification, or other Contest-related correspondence is faulty, rejected, or returned as undeliverable, that potential winner may be disqualified without notification and an alternate potential winner may be selected at Sponsor’s discretion, time permitting. A potential winner (or alternate) is not official and will not be confirmed as a winner until he/she has completed, signed and returned any documentation which may be required by Sponsor, the eligibility of the potential winner has been verified, and he/she has received official notification from Administrator. Grand Prize Winner’s guest must be at least 18 years of age and will be required to sign and return a travel release when requested. Contest submissions are subject to validation by the Administrator. In addition, Sponsor reserves the right, at its sole discretion, to disqualify any Grand Prize Winner or potential Grand Prize Winner prior to, or during the prize trip, in the event Sponsor determines, in its sole discretion, any activity of or information about the Grand Prize Winner or his/her guest that would harm the reputation of Sponsor. By taking part in this Contest you agree to be bound by these rules and all decisions of the Administrator and Sponsor, which are final and binding on all aspects of the Sweepstakes.
GRANT OF RIGHTS: Entrants authorize the Sponsor and its agents to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, in Sponsor’s sole discretion, without further obligation or compensation. Further, winners agree to be available for publicity purposes for the Contest and provide the Sponsor and its agents all rights to use such materials for promotional purposes, without further compensation, unless prohibited by law.
GENERAL CONDITIONS/INDEMNIFICATION: By participating in this Contest and/or by accepting any Contest prize that you may be awarded, you agree that Sponsor, the Administrator, WWE, and each of their respective parents, subsidiaries and affiliated companies, units and divisions; and their advertising and promotional agencies and prize suppliers; each of their respective officers, directors, members, agents, representatives and employees; and each of these companies’ and individuals’ respective successors, representatives and assigns (collectively, the "Released Entities ") shall not be liable for any and all actions, claims, including any third-party claims, injury, loss or damage arising in any manner, directly or indirectly, arising from or relating to this Contest, including entry and participation in this Contest, or the acceptance, possession, use or misuse of any prize, or any prize-related activity. By participating in the Contest and/or accepting any prize that you may be awarded, you agree to fully indemnify each Released Entity from any and all such claims by third parties without limitation. The Released Entities shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or submissions, regardless of the method of transmission; (ii) telephone system, telephone, mobile device or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by your participation in this Contest or resulting from acceptance, possession, use or misuse of a prize; (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest; (vi) potential winner’s inability to attend event; or (vii) any postponement or cancellation of the event or travel. Released Entities disclaim any liability for damage to any phone or other electronic device resulting from participating in, or accessing or downloading information in connection with this Contest should a virus, bug, computer or phone problem, unauthorized intervention or any other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Contest.
MODIFICATION OR TERMINATION. Sponsor reserves the right in its sole discretion to modify, cancel, suspend or terminate the Contest in its entirety or any affected portion thereof in the event the Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to the inability to timely validate winners, the cancellation or postponement of the event, any natural or man-made disasters, or other cause not reasonably within Sponsor’s control. If the Contest or a particular portion thereof is canceled or terminated before the designated end date for any reason, Sponsor may (if possible) select the winner based upon all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Only the type and quantity of prizes described in these Official Rules will be awarded.
IMPROPER CONDUCT: Sponsor may prohibit you from participating in the Contest or winning a prize if, in its sole discretion, it determines you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or Sponsor representatives.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST APP OR OTHER MATERIALS OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST, OR INTERFERENCE WITH ANOTHER’S ABILITY TO PARTICIPATE IN THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHALL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
BINDING ARBITRATION: EXCEPT WHERE PROHIBITED BY LAW, ENTRANTS AGREE THAT: (I) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE CONTEST, OR ANY PRIZE AWARDED OR ANY PRIZE-RELATED ACTIVITY, SHALL BE RESOLVED INDIVIDUALLY -- WITHOUT RESORT TO ANY FORM OF CLASS ACTION -- BY BINDING ARBITRATION (BY A SINGLE NEUTRAL ARBITRATOR SELECTED BY SPONSOR IN ITS SOLE AND ABSOLUTE DISCRETION) ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES AND THE SUPPLEMENTARY PROCEDURES FOR CONSUMER RELATED DISPUTES (THE “AAA RULES”) THEN IN EFFECT; (III) ANY ARBITRATION SHALL BE HEARD BY ONE ARBITRATOR IN NEW YORK, NY TO BE SELECTED IN ACCORDANCE WITH THE AAA RULES; (IV) UNLESS BOTH ENTRANT AND SPONSOR AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING; (V) JUDGMENT UPON ANY AWARD RENDERED MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF; AND (VI) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE SUBJECT TO ALL LIMITATIONS AND RELEASES SET FORTH IN THESE OFFICIAL RULES AND LIMITED TO ACTUAL OUT-OF-POCKET DAMAGES, BUT IN NO EVENT SHALL SUCH CLAIMS, JUDGMENTS OR AWARDS INCLUDE ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ATTORNEYS' FEES OR COSTS OF BRINGING A CLAIM, ANY INJUNCTIVE OR OTHER EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN THE EVENT SUCH ARBITRATION CANNOT BE COMPELLED, ENTRANTS AGREE THAT ANY OF THE ABOVE CLAIMS MUST BE BROUGHT INDIVIDUALLY (WITHOUT RESORT TO CLASS ACTION) IN THE STATE OR FEDERAL COURTS LOCATED IN NEW YORK, NY, USA, AND AGREE TO WAIVE ANY RIGHT TO JURY TRIAL AND THAT ANY RECOVERY SHALL BE LIMITED AS SPECIFIED ABOVE.
GOVERNING LAW: All federal, state and local laws and regulations apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Released Entities in connection with the Contest, shall be governed by, and construed in accordance with New York law without giving effect to any choice of law or conflict of laws. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
